The court overruled debtor's objection to her lender's claim, finding that she had no standing to challenge the bank's lending practices, nor was there any legal authority supporting her efforts to nullify her contractual obligation to pay the note.

The bankruptcy court dismissed for lack of jurisdiction the debtor-plaintiff's attempt to collaterally attack pre-petition state court proceedings which resulted in the debtor being removed from real property that had been sold at a sheriff's sale

The term "immediate personal possessions" is not well-defined in Nebraska exemption law. While it includes certain sentimental articles, it does not cover property that is more appropriately scheduled under another category of exemptions.

After trial, the court found that counsel's erroneous affidavits and inaccurate statements in attempts to collect a discharged debt were "serious mistakes" and violated the discharge injunction,  but were not in the nature of contempt of court.

Debtor's prior Ch. 13 case was dismissed for plan payment default and failure to file an amended plan. The circumstances do not indicate a "willful failure" to abide by court orders, so the filing of the second case did not violate section 109 (g)(1)

The court denied plaintiff's motion for sanctions for certain discovery disputes. Neither side had completely abided by discovery rules. The problems were solvable, so the parties were directed to try again to comply with the discovery requests.

The court denied the debtors' motion to strip off a junior lien on their residential real property because there was no evidence in the record that the lien was wholly unsecured.

The court analyzed the "good faith" of debtor's proposed Chapter 13 plan under the factors in Estus, 695 F.2d 311 (8th Cir. 1982), and Zellner, 827 F.2d 122 (8th Cir. 1987), and concluded that, with a few modifications, an amended plan could be confirmed

An unsecured junior lien on the debtor's residential real estate may be avoided after the debtor completes Chapter 13 plan payments. The case law in the Eighth Circuit, interpreting Nobelman, permits wholly unsecured liens to be stripped off.

Because the bankruptcy court in this district has no jurisdiction to enter orders finding criminal contempt, it denied as frivolous debtor's motion for a court-funded transcript with which to appeal an order denying his motion for criminal contempt
