Prior to discharge, the Chapter 7 debtor did not move to avoid a judgment lien attached to her real estate. When the creditor then attempted to levy on the property, the court allowed the debtor to reopen the case in order to file a lien avoidance motion.

Pursuant to BAPCPA's "hanging paragraph" following § 1325(a)(9), a debtor may surrender a vehicle purchased within the 910-day period preceding the petition date in full payment of the debt, even if the surrender results in a deficiency claim.

Published at 210 B.R. 344. A lump-sum payment owed by debtor to his former wife as part of a property settlement in connection with their divorce was not dischargeable. Under sec. 523(a)(15), the debtor was able to pay it and the balancing of detriment and benefit was about equal.

The court granted a lender's motion for relief from stay after finding bad faith on the part of the debtor. The debtor had insufficient income to support herself, a tenuous grasp of her financial situation, and little ability to restructure her debt.

Cause existed to grant stay relief to a creditor to obtain a state court judgment against the debtor, as Nebraska law prohibited the creditor from getting a judgment against an individual partner unless it first had a judgment against the partnership

The court granted stay relief to two lien-holders in a parcel of real estate because they were not adequately protected. The property's value had declined since the petition date and taxes and interest had accrued, reducing the lien-holders' security

The court deferred ruling on the final fee application of counsel for the debtor, and objection by the personal injury creditors, pending the submission of additional information to reconcile and clarify some of the charges on the billing statements.

The court denied the ex-husband's objection to confirmation. Debtor incurred post-divorce debt on a joint credit card, but there is no evidence the ex-husband is liable for the debt. The court found the case and the plan to have been filed in good faith.

The deed of trust holder's motion for relief from stay was denied without prejudice to permit the debtor to resume making monthly payments and cure payments. If debtor becomes delinquent again, the creditor is entitled to relief without a hearing.
