Some claims raised by creditors about the conduct of persons associated with the debtor are not "control person" claims under securities law and are not covered by the automatic stay. They are therefore subject to arbitration by a regulatory agency.

The court disallowed a claim that was based on two promissory notes signed by the debtor in 1997. The statutory five-year limitations period of Neb. Rev. Stat. § 25-205 had expired with no action brought and no payments made, so collection was barred.

Because the purchase money lender's lien was not on the title certificate, the security interest was unperfected & subordinate to the trustee's hypothetical lien. Likewise, the lender's interest in accessions to the vehicle was also unperfected.

The court denied debtors' motion for contempt against their mortgage lender after finding that the debtors had reaffirmed the debt, so the lender's post-discharge communications and requests for payment did not violate the discharge injunction.

In exempting tools, the court said, "There is no statutory requirement of a continuous stream of income from the use of the tools for a claim of exemption to be allowed. There is a business, there is some advertising, and there is some hope [by debtor]."

The presumption of insolvency in this preference action was unrebutted by the defendant after the trustee showed that the schedules didn't truly reflect asset values. However, a question of fact existed as to the ordinary course of business defense.

Debtor moved for turnover of garnished funds as subject to a child-support order and as exempt. The court found the garnishment to be superior to the support order, but ruled the debtor could avoid the lien on the exempt portion of the garnished funds

In the parties' divorce decree, the debtor was ordered to pay the second mortgage on the home awarded to his former wife. The parties intended the debt to be in the nature of support and it therefore is a non-dischargeable domestic support obligation.

The court liberally construed the Nebraska exemption statutes and found that a debtor may claim a tool of the trade exemption in a vehicle, even if the debtor is unemployed on the petition date, as long as the debtor can show intent to begin working again.
