Trustee could not use the turnover statute to recover funds the debtor inherited and spent during the pendency of the case, but the court made clear that any future distributions were property of the bankruptcy estate and should be paid to the trustee.

The bank's contractual rights to the flow of payments received by the debtor under a purchase agreement may have priority over certain set-off rights claimed by the buyer. The court granted relief to the bank to obtain a determination of those rights.

The debtor signed a signature card on a deposit account with his parents. They did not intend the debtor to be an owner of the account. Because the bank's documents did not conform to state requirements, the bank was not entitled to set off the account.

The court denied summary judgment because a fact question existed as to (1) whether the debtor's purchase of a trailer leased by the seller was in good faith as a buyer in the ordinary course of business, and (2) what property rights the debtor obtained.

The official committee of construction lien claimants was allowed to intervene in an adversary proceeding between the trustee and the lender regarding lien validity, because there was a lack of commonality of interests on some of the claims raised.

Reported at 417 B.R. 593. The court warned the debtors that executing an payment agreement to delay a trustee's sale but defaulting within weeks and filing bankruptcy "comes very close to not meeting the ‘smell test' with regard to good/bad faith."

The court ruled that the funds in the 50-year-old debtor's Individual Retirement Account, which were rolled over from a previous long-term employer's 401(k) retirement plan, were necessary for the debtor's support and were therefore exempt.

Defendant subcontracted with debtor for a security system installation project. Work delays and disruptions, although caused by the project owner, were ultimately the responsibility of the defendant, so it was liable to debtor for the additional costs

The court considered the Eighth Circuit's Estus & Zellner factors regarding good faith in Chapter 13 cases in determining that a debtor's conversion of his case from Chapter 7 to Chapter 13 to avoid a non-dischargeability trial was not done in bad faith
