Proof of Claim

NOTES:

  • To file a Proof of Claim form in CMECF, you must complete/save the form as a pdf document, and follow the steps below.  See PDF Document Basics for information regarding pdf documents.
  • Before filing the claim, ensure to redact personal identifying information described in Fed. R. Bankr. P. 9037(a). 
  1. Select Bankruptcy > File Claims
  2. Enter Case Number (e.g. xx-xxxxx).  Leave the Name of creditor text box blank.  Click Next.
  3. On the Select a Creditor for Claim screen:
    • NOTE: When filing the claim use the “noticing” address.  Do not use the “payment” address.
    • Click on the down arrow to search for the creditor.  If you find the creditor's name and address listed, then it must match the name and address listed on your Proof of Claim form:
      • If the match is exact, select it, click Next, and skip to step #9.
      • If the creditor's name is not listed or the match is not exact, select Add Creditor, and proceed to step #4.
  4. Enter Case Number (e.g. xx-xxxxx). Click Next.
  5. Adding a Creditor screen:
    • Type the exact information that is listed on the pdf Proof of Claim Form; Creditor's name, address (ensure it is the noticing address, not the payment address), state, city, and zip code in the Name and Address text box.
    • Leave Creditor type to Creditor.
    • Leave Creditor committee at No.
    • Click Next.
    • Review the Total Creditors Entered, which should read one (1).
    • Click Submit.
  6. On the Creditors Receipt screen, click File a Proof of Claim.
  7. Enter Case Number (e.g. xx-xxxxx). Leave the Name of creditor text box blank. Click Next.
  8. On the Select a Creditor for Claim screen:
    • NOTE: When filing the claim use the “noticing” address.  Do not use the “payment” address.
    • Click on the drop down box to search for the creditor, and select it.  Click Next.
  9. On the Proof of Claim Information screen:
    • Enter information in all applicable text boxes.Click Next.
  10. Click Browse and attach the Proof of Claim pdf file.  Click Next.
    • If there are documents to attach to the Proof of Claim, then next to Attachment to Document select Yes.  Click Next.
    • On the Select one or more attachments, click Browse, attach the pdf file, and follow steps #2 and #3 reference on the screen, click Next.
  11. The Notice of Electronic Claims Filing Screen indicates the claim has been filed.
