First, the Judicial Conference approved an increase to the adversary filing fee in bankruptcy proceedings. The new fee will be equivalent to the filing fee for civil cases in district courts, $350, an increase of $57 from the current bankruptcy adversary filing fee of $293.
Second, the Conference approved an increase in the Administrative fee (currently $46) assessed at the filing in every bankruptcy case. The administrative fee will increase to $75 for Chapter 7, 12, and 13 cases, and to $550 for Chapter 9, 11, and 15 cases.
New Case filing fees effective June 1, 2014
Chapter 7 $335
Chapter 9 $1717
Chapter 11 $1717
Chapter 11 Railroad $1550
Chapter 12 $275
Chapter 13 $310
Chapter 15 $1717
The Conference also approved applying the new administrative fee structure to "divided" bankruptcy cases. Therefore, the amended fee schedule will require that an administrative fee be paid when a case is divided (which will be the same fee as that charged for initial cases filed under that chapter).
The revised fee schedule can be found on the courts website www.neb.uscourts.gov - Court Info - Court Fees - Fee Schedule effective June 1, 2014. The filing fees that will change are highlighted in yellow.
FYI, Just a reminder......The $176 filing fee for Motion to Sell Property of the Estate Free and Clear of Liens under 11 U.S.C. Section 363(f) was effective last Dec. 1, 2013.
