The court granted in part the debtor's requests for discovery in connection with his motion to remove the Chapter 7 trustee. The trustee was directed to produce what he reasonably could, but needn't concern himself with superfluous requests.

Debtor's objections to the trustee's attorney's fee application were overruled. The trustee may employ himself as counsel and be compensated from the estate for his services as counsel if those services were necessary and beneficial to the estate.

In claims litigation, the court permitted, in limited scope, the pro se debtor's attempts to obtain discovery from two banks and a surety company, to the extent the documents requested were readily available and relatively easy to produce.

Debtor's manager's personal friendship with the debtor's banker did not create a fiduciary duty owed by the bank. The borrower was financially savvy and was not subject to the bank's control or influence. This was a standard lending relationship.

The debtor's officer had a contractual right to be paid a percentage of certain settlement proceeds for his assistance with the litigation. The court authorized his portion of the proceeds to be paid directly to one of his creditors on its claim.

Factual disputes precluded summary judgment on issues of the foreseeability of damages for lost profits, the accrual of the cause of action, and the weight to be given to an expert's opinion in a breach of contract lawsuit against the City of Omaha

The court granted leave to debtor to file an amended complaint, which should take into account a release of certain claims executed by the parties. The amended complaint should also clarify the defendants involved and whether there is a jury demand.

Counsel's fees and expenses, although allowed, may not be paid from an objecting creditor's cash collateral unless the secured creditor is adequately protected.

The bank's motion for relief was denied because the debtor provided sufficient evidence of the likelihood of a successful reorganization. Specific issues regarding feasibility of the debtor's plan would be addressed at the confirmation hearing.

C.O.D. funds collected by UPS that are cash or cash equivalent may be set off against debt owed to UPS. However, C.O.D. funds in the form of checks payable to the debtor may not be set off and should be turned over to the debtor as property of the estate.
