The court dismissed this Chapter 12 case because the debtors did not meet the definition of family farmers. They had no livestock or machinery and did not operate their farm. Rather, they received cash rent for the land and wages for labor they provided.

Affirmed at 617 F.3d 1065 (8th Cir. 2010). The time limit in § 546(a) is a statute of limitations. The two-year period begins running on the day after the bankruptcy petition is filed, and expires on the second anniversary of the petition date.

The debtor had an interest in stock shares given to him and his wife by his in-laws, so to the extent he transferred those interests to his wife within four years prior to filing bankruptcy, the transfers were avoidable by the trustee as fraudulent.

Debtor's ex-wife sought relief from stay to appeal the divorce, to continue a contempt action and to move against estate property for payment of child support. Court granted the first two motions but said that notice must be given first on final motion.

The court denied a franchisor's motion for relief, finding that although the debtor had not made all of the ordered royalty payments, it had "substantially complied" with the order. If the debtor failed to fully comply, the court would grant relief.

A complaint need only contain facts that, accepted as true, state a plausible claim for relief. Plaintiff here included facts in the complaint from which he arguably may be able to prove that the defendant is an insider, so dismissal is not warranted.

A finding regarding the ownership of jointly held stock by the non-debtor spouse in a dischargeability action did not collaterally estop the trustee from pursuing an avoidance action against her alleging fraudulent or preferential transfers.
