This form should be filed only if all of the following are true:
- this appeal is pending in a district served by a Bankruptcy Appellate Panel,
- the appellant(s) did not elect in the Notice of Appeal to proceed in the District Court rather than in the Bankruptcy Appellate Panel,
- no other appellee has filed a statement of election to proceed in the District Court, and
- you elected to proceed in the District Court.
- Select Bankruptcy > Appeal
- Enter Case Number (e.g. xx-xxxxx). Click Next.
- Select Appellee Statement of Election from the event list. Click Next.
- Click Next to skip the Joint Filing Screen.
- Select the Party filer. Click Next.
- If the party is not listed, click on Add/Create New Party.
- The Attorney/Party Association screen may appear. If your party selection was correct, check the box to create an association.
- Select Browse to attach the pdf file. Click Next.
- Select the appropriate event(s) to which your Appellee Statement of Election relates and click Next
- Click Next.
- Verify the final docket text before submitting. If correct, click Next.
CAUTION!! This is the last screen. Clicking Next will submit your document to CM/ECF. If the final docket text is incorrect, click the Back button to find the screen to modify or abort the transaction by clicking on Bankruptcy on the CM/ECF Menu bar. - Notice of Electronic Filing/Receipt screen displays
