The district court remanded with instructions to the bankruptcy court to make an evidentiary record in support of its factual findings regarding the nature of a particular claim & whether the holder of that claim could vote in favor of a Chapter 11 plan

Debtor alleged emotional distress when Texas company refused to move her belongings to Neb. until she paid storage & transit charges and paid off a purchase-money lien on the goods. Court said Neb. law applied, then dismissed for failure to state a claim

The court denied confirmation of a Chapter 11 plan because it contained an 18-month "safe harbor" during which secured creditors would have neither their property nor the value of their claims. A proposed amendment could be circulated for votes

The complaint in this adversary proceeding was dismissed when the plaintiff failed to appear for trial. However, the court retained jurisdiction over the debtor-defendant's counterclaim

Court denied mortgage-holders' request for relief from stay because there was no evidence the mortgages on this asset were in default or that any of the mortgagees had been harmed. The debtor had also recently filed a Chap. 11 plan to deal with the debts

District court affirmed the bankruptcy court's decision to allow debtor to assume as an executory contract a contract to sell real estate. The contract had not been terminated, & under the Countryman definition, performance remained due on both sides
