Rule 3017-1. Chapter 11 - Small Business Cases

Chapter:
Part III. Claims and Distribution to Creditors and Equity Interest Holders; Plans

In a Chapter 11 small business case, after the debtor files a disclosure statement and plan, the United States Trustee will file a statement as to the adequacy of the disclosure statement for conditional approval. If the United States Trustee determines the disclosure statement is adequate, the court may enter an order conditionally approving the disclosure statement and will set the final hearing date and establish other deadlines. The court will consider final approval of the disclosure statement and confirmation of the plan on the final hearing date. If the United States Trustee determines the disclosure statement is inadequate for conditional approval, it will be set for hearing.
