Notice to Customers Presenting Checks

Effective May 1, 2012, the United States Bankruptcy Clerk’s office for the District of Nebraska will begin processing payments made by check using Paper Check Conversion.

This notice advises that by presenting your check to the Clerk’s office as payment, you authorize the conversion of your check into an electronic funds transfer from your bank account for the amount of the check.

By using electronic funds transfer, the transfer of funds from your account may occur within 24 hours; therefore, upon payment, there should be sufficient funds in the account to process the transaction.  In the event of insufficient funds, the transaction may be submitted multiple times.

Any payments that are returned due to Non-Sufficient Funds (NSF) will be subject to the $53.00 NSF/Returned Check fee.  Should this occur, the Clerk of Court may require payment by cash, money order, or credit card for replacement of the initial fee, as well as the $53.00 NSF/Returned Check Fee.

The Privacy Act -5 § 522a (e) (3) states that as an Agency of the United States of America, we may request additional information directly related to processing of the payment submitted.  As stated under the Code, it is solely at your discretion if you desire to comply with the request(s); however, should you fail to comply, as an Agency, we may decline the method of payment and require another form of payment.
