The Court has noted a substantial increase in the number of ALC fee requests that are in violation of the limitations set forth in Appendix K, paragraph 3(d) -- in particular fee requests for services that are mere amendments to services for which compensation has already been approved, and motions that are withdrawn or denied for failure to follow rules after fees have been awarded. Therefore, the court has modified Appendix K and Appendix N to prohibit the filing of ALC certifications until ALL services for a particular action are complete, and to reiterate the need to comply with the limitations on ALC fees set forth in Appendix K. Copies of the amended appendices can be found on the court's website at www.neb.uscourts.gov - Court Info - Local Rules and Orders.
Appendix K was updated to include the following language.
Added to the end of Paragraph 3.a. :NOTE: Attorneys should not file a Certification of ALC fees (i) until ALL actions are completed (including ruling by the court) with respect to the service for which the fees are requested; and/or (ii) if the request is in violation of the limitations in sub-paragraph (d) below.
Appendix N was updated to include the following language.
Added to the end of paragraph 2: All actions (including ruling by the Court) with respect to the services for which the fees are requested have been completed and this request is not in violations of the limitations on ALC fee requests set forth in Appendix K.
